Terms and conditions

Parties and scope

These terms govern the booking and occupation of the property advertised on this website. They are agreed between:

• VillaCubaAnita, Calle 1, Boca de Camarioca, Matanzas, Cuba ("we", "the host"); and
• the person who makes the booking ("you", "the guest"), who must be at least 18 years old and who is responsible for everyone in their party.

By completing a booking you confirm that you accept these terms and our Privacy Policy.

Making a request

You may request one or more individual rooms. The house is not let as a whole.

1. Sending a request is not a booking, and it does not reserve the dates. They remain on sale, and more than one guest may have an open request for the same nights.
2. We check availability and reply to you, normally within [24-48 hours], confirming whether we can host you, the final price and how to pay.
3. A booking exists only once we confirm it to you in writing. Until then nothing is owed by either side, and you may withdraw your request at any time at no cost.
4. If we cannot host the dates you asked for, we will tell you and, where we can, suggest alternatives.
5. The remaining rooms and the shared areas — kitchen, living room, garden and, where indicated, bathrooms — may be used by other guests at the same time.
6. Family rate: a party of three or four people from the same family may book the king-size room together with one double room at the pair rate shown in the form, rather than at the price of the two rooms separately. Asking for it is a declaration that this is the case; we may ask you to evidence it and, where it does not hold, charge the ordinary price of the two rooms.
7. Occupancy may not exceed the maximum stated for the accommodation booked. Additional guests may be refused entry.
8. The minimum stay, check-in and check-out times are those shown on the booking form at the time of your request. Late check-out must be agreed in advance and may be charged.

Prices and what you pay

1. Prices are shown in US dollars (USD) and include the cleaning fee where one applies.
2. The amount shown when you send a request is an estimate, calculated from our published rates. It is not a charge and it is not binding on either side.
3. The final price is the one we state in our reply, and it becomes binding only when you accept it and we confirm the booking.
4. No payment is taken through this website. We do not collect or store card details, and you are never asked for them here.
5. How and when you pay is agreed directly with us when we confirm. We will set out the accepted methods, any amount due in advance, and the deadline.
6. Where a payment involves converting currency, your own bank or provider may apply its own rate and fees. Those are outside our control.

Confirmation

1. We reply to every request. Our reply states whether the dates are available, the final price, what is payable in advance and by when, and how to pay.
2. The dates are taken off sale only when we confirm the booking. Until that moment they remain available to other guests, however long your request has been open.
3. If you do not reply to our confirmation within the period we state, we may release the dates and offer them to someone else.
4. A request we never manage to answer is closed automatically after [14] days. That closes the enquiry only; it does not create or cancel any booking, because none existed.
5. Keep your reference number. It identifies your request in any correspondence and in any payment we agree.

Cancellation and changes

Withdrawing a request. A request that we have not yet confirmed can be withdrawn at any time, in writing, at no cost. Nothing has been charged and no dates were held.

If you cancel a confirmed booking:

Refunds are made by the same route the payment arrived, within [14] days. Bank charges for returning funds may be deducted.

If we cancel: if we have to cancel a confirmed booking for any reason within our control, we refund everything you have paid in full, and we will help you find comparable accommodation where we can. Our liability in that situation is limited as set out in section 8.

Changes: you may request a change of dates at least [14] days before arrival. We will accommodate it where availability allows; a price difference may apply.

House rules

1. Check-in from [15:00], check-out by [11:00].
2. No smoking anywhere indoors. Smoking indoors incurs a cleaning charge of [AMOUNT].
3. Pets are welcome on prior request only, and a supplement of [AMOUNT] applies. Undeclared pets may result in the booking being ended without a refund.
4. Quiet hours are [22:00]–[08:00]. Please respect the neighbours.
5. No parties or events. The property is a home, not a venue.
6. Only the guests named in the booking may stay overnight.
7. Please leave the kitchen and shared areas as you found them. When individual rooms are booked, shared areas are shared in good faith with the other guests.
8. Report any damage or fault as soon as you notice it — accidents happen and we would rather know.
9. Illegal activity on the premises ends the stay immediately, without a refund.

Security deposit and damage

1. A refundable security deposit of [AMOUNT] may be requested before arrival, as agreed when we confirm.
2. It is returned within [7] days of check-out, less the documented cost of any damage beyond fair wear and tear, missing items, or extraordinary cleaning.
3. We will send you photographs and an itemised cost for anything we deduct.
4. You remain liable for damage that exceeds the deposit.

Liability

1. We are liable for damage caused by our own negligence or wilful misconduct, and nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.
2. Subject to that, our total liability arising from a booking is limited to the total amount you paid for that booking.
3. We are not liable for loss of or damage to your personal belongings, except where caused by our negligence. Please use the safe where one is provided.
4. You use the garden, terrace, kitchen and any equipment at your own responsibility, and you supervise children in your party.
5. Nothing in this section affects your statutory rights as a consumer, which vary by country and always take precedence over these terms.

Governing law and disputes

1. The property is in Cuba and the stay is provided there, so these terms are governed by Cuban law and the Cuban courts have jurisdiction.
2. If you are a consumer resident in the EU, this choice does not deprive you of the protection of the mandatory consumer rules of your own country, and you may also bring proceedings in the courts of your country of residence. EU consumers may use the European Commission's online dispute resolution platform.
3. If any provision of these terms is found unenforceable, the rest remains in force.
